1. Placing an order
1.1
To register your order and for SCCD to progress with a vehicle movement you will need to confirm your instruction via email and by doing so you accept these standard terms and conditions unless specifically agreed in writing in advance. Please note that SCCD cannot accept verbal vehicle movement instructions.1.2
Your order confirmation must highlight the key points of the movement (including but not limited to: collection & delivery address, contact names and details, required dates and any specific instructions.) We reserve the right to make a surcharge for any work in hand, or work completed, that differs from the original order (e.g. changes to collection/delivery times, changes of address, excessive waiting times, and changes to vehicle type or size).1.3
All additional costs related to the movement will be recharged back to the customer, including but not limited to: fuel, electric vehicle recharges, tolls, non fault damage, breakdown & associated costs, etc…1.4
By placing your order confirmation you are confirming that the vehicle is available for collection on the dates specified and is in a roadworthy drivable condition. Including but not limited to: You are authorised to arrange for the movement of the vehicle, the vehicle has no warning lights or defects, etc… the tyres are legal, the vehicle has a full MOT to cover the full movement period, and the vehicle has sufficient fuel or charge to get us to the nearest station.

Once a collection has been ordered and the collection date agreed we reserve the right to make a surcharge for: 1.5.1 Cancellations or aborted collections/deliveries where notification has been given after 2pm on the working day prior, AND 1.5.2 Waiting time, which is chargeable at £20 per every hour, effective from the time of notification.1.6
During our period of responsibility, from collection confirmation to delivery confirmation all vehicles are covered by our Goods In Transit insurance; a copy is available on request. Any additional insurance required for loads in excess of our Goods In Transit insurance, will be negotiated and may be invoiced in addition to the agreed movement quotation.1.7
Every care and attention is given to your vehicle movement whilst in our period of responsibility however, customers are reminded that if they choose to have a vehicle moved by plate delivery (road driven) minor damage from road surfaces may occur, e.g stone chips on bodywork/windscreen, tyre damage/blowouts. Unless the movement is covered by the additional ‘stone chip cover’ SCCD takes no responsibility for any non fault road damage whilst the vehicle is in transit. This includes, but is not limited to; stone chips of any kind & pothole related damage. (Please note that ‘stone chip’ insurance cover is available at an additional charge of £10.00 + VAT when the job is booked).1.8
Customers are advised that vehicle movements are available by individual car transporter for non road worthy vehicles, long distance or simply to avoid non fault road damage. This option must be agreed in advance at the point of ordering.1.9
Customers either buying or selling vehicles must be aware that the inspection of this vehicle is completed by our driver, and therefore the completed inspection report does not reflect the true value or worth of the vehicle. The inspection is not for that reason. The inspection is meant only to indicate and record significant damage found on the vehicle at the time of collection, so that responsibility for damage cannot be attributed to our driver during the transit of the vehicle.

Payment terms are strictly 30 days from invoice date. Please note that for your 1st order payment is required in advance prior to order confirmation.2. On The Day
2.1
Every effort will be made to ensure collection and delivery times are adhered to, however due to unforeseen circumstances, i.e. traffic jams, accidents, and weather conditions etc, no guarantees can be made in relation to problems/delays of this nature.2.2
We will call in advance to provide an estimated time of arrival, ETA. Please ensure that the vehicle is available to inspect, fuelled, roadworthy and free from obstruction before the driver arrives. We reserve the right to charge for waiting time in the event the collection/delivery is delayed.2.3
All driving staff are instructed to carry out an inspection of the vehicle prior to collection. Damage found will be recorded on their inspection report. The driver will ask for the report to be signed prior to moving the vehicle and handover completion. The quality and thoroughness of the driver’s inspection is dependent on various conditions e.g. weather, lighting and vehicle condition and cleanliness. If these conditions are not favourable, the driver may not be able to complete a thorough inspection of the vehicle. In situations of this nature, this company will not accept liability for any damage missed off the inspection sheet.

Drivers are instructed to fuel vehicles as required, fuel quantities and prices may vary depending on individual vehicle calibration/tank levels or filling stations used. The cost of fuel used on each vehicle movement will be included on the relevant invoice. Fuel charges are based on current pump prices.2.5
From time to time the vehicle may travel additional mileage than quoted on the order for additional travel such as; avoiding travel congestion, route diversions or overnight stays. In these circumstances SCCD will only charge the quoted miles.2.6
Upon delivery of the vehicle the driver will ask for their delivery report to be signed. The delivery report has facilities for recording damage of the vehicle or for making comments regarding the delivery. The receiver of the vehicle is invited to inspect the vehicle and record their findings. Any damage not notified on the P.O.D (Proof of Delivery Note), will not be accepted by us, unless and notwithstanding, we are notified in writing within 24 hours of delivery, and the damage can be viewed by us prior to any repairs.3. Breakdown and Disputes
3.1
SCCD will respond to all queries and complaints within 48 hours following the day of receipt.3.2
SCCD understands that from time to time vehicle movements don’t always go as planned with many factors outside of both parties’ control. Southern Counties Car Deliveries will always act reasonably in informing the customer of any issues and work to resolve any issues and reduce any additional costs.3.3
In the event that the vehicle breaks down in transit to the delivery location, the customer will be contacted and asked how they would prefer to proceed. If the vehicle is covered by a roadside assistance breakdown company, we can take these details and have the vehicle repaired/recovered on the customer’s existing cover. If the vehicle is not covered, or the breakdown is out of hours and we can’t contact you, Southern Counties Car Deliveries will instruct our recovery company to attend to the vehicle. Please note that all additional costs involved using SCCD recovery agent will be chargeable in full and that from time to time we may not be able to confirm the complete additional costs until the recovery has been completed.3.4
In addition to additional recovery costs and the agreed job price, SCCD will charge waiting time at £20 per hour effective from the time of notification.3.5
Any damage claims must be submitted by email within 24 hours of delivery, we cannot accept any claims raised after this period. If we accept responsibility then you will be required to provide a detailed estimate and we reserve the right to claim any replaced part as proof of repair. Southern Counties Car Deliveries will not be held responsible for any damage that cannot be attributable to negligence on behalf of Car Collection Service or their staff. I.e. Acts of God, (storm damage, bird strike, bird droppings etc.), stone chips, pothole damage, acts of vandalism not preventable by Southern Counties Car Deliveries. Vehicles damaged whilst in our care, which we accept liability for, will be repaired and delivery completed. Southern Counties Car Deliveries will not provide hire cars, replacement vehicles or compensation whilst the vehicle is being repaired.
4. Non-Solicitation Obligation
4.1
You agree that, during the term of engagement with Southern Counties Car Deliveries and for a period of 2 years following the completion of any engagement with Southern Counties Car Deliveries, you shall not, directly or indirectly, for yourself or on behalf of any other person or entity:
- Solicit, induce, or encourage any of the Southern Counties representatives to terminate their relationship with Southern Counties Car Deliveries
- Hire, employ, or engage as an independent contractor any of Southern Counties Car Deliveries representatives
- Attempt to divert any of the Company’s representatives from their relationship with Southern Counties Car Deliveries
For the purposes of this clause, “driver” shall mean any individual who is, or was engaged by Southern Counties Car Deliveries as an employee, independent contractor, or in any other capacity primarily involved in the operation of vehicle movements.
